Terms of Service & License Agreement

1The service

Clutch Alarm sends notifications about live sports events based on conditions you set (for example a close game, a comeback, a red card, a penalty, or a player passing a stat threshold). The app is provided for personal, informational, and entertainment purposes only.

2License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, in accordance with these Terms and Apple's App Store Terms of Service.

3No affiliation

Clutch Alarm is an independent application. It is not affiliated with, endorsed by, sponsored by, or connected to any sports league, club, team, federation, association, or competition — including, without limitation, FIFA, the FIFA World Cup, the NBA, the Premier League, EuroLeague, or any other rights holder. All team, league, and competition names, logos, and trademarks are the property of their respective owners and are used for identification and informational purposes only.

4Accuracy of data; no reliance

Scores, statistics, fixtures, lineups, broadcast information, and other data are obtained from third-party data providers and are provided "as is". They may be delayed, incomplete, or inaccurate. You must not rely on the app for any purpose where accuracy or timeliness is critical — including, without limitation, betting, wagering, or financial decisions. We are not responsible for any loss arising from reliance on the data.

5Notifications

Notification delivery depends on Apple's and Google's push services, your device settings, network connectivity, and third-party data. We do not guarantee that any notification will be delivered, delivered on time, or delivered at all. Do not use the app as your sole or critical means of being alerted to any event.

6Acceptable use

You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the app, except as permitted by law; (b) use the app for any unlawful purpose; (c) interfere with or disrupt the app or its servers; or (d) resell, redistribute, or commercially exploit the app or its data.

7Intellectual property

The app — including its design, code, text, and original graphics — is owned by Clutch Alarm and protected by intellectual-property laws. Except for the license in Section 2, no rights are granted to you. Third-party trademarks remain the property of their owners (see Section 3).

8Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.

9Limitation of liability

To the maximum extent permitted by law, Clutch Alarm and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) the app. Our total liability for any claim relating to the app will not exceed the amount you paid for the app (if any) in the twelve months before the claim.

10Changes

We may modify the app or these Terms at any time. We will update the "Effective date" above, and material changes will be reflected in the app. Continued use after changes constitutes acceptance.

11Termination

We may suspend or terminate your access to the app or its services at any time. You may stop using the app at any time by uninstalling it.

12Governing law

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law rules. Where mandatory consumer-protection laws of your country of residence apply, nothing in these Terms limits those rights.

13Apple App Store (EULA terms)

This app is licensed, not sold, to you. The following apply when you obtain the app through Apple's App Store:

• These Terms are concluded between you and Clutch Alarm only, and not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to furnish any maintenance or support services for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or any third party relating to the app, including product-liability, legal/regulatory, or intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government restricted-parties list.
